Yesterday, the Bombay high court while hearing a public Interest litigation (PIL) challenging the central government’s decision to implement the goods and services tax (GST) as it would be a major tax reforms to be implemented in the middle of the financial year, the court reserved its order on a plea seeking deferring of  implementation of the goods and services tax (GST).

 

What the petitioner urged:

KS Pillai was the petitioner and urged the court to direct the government to defer the implementation till the beginning of the next financial year as implementation of GST would be a major tax reforms in the middle of the financial year.

 

Defendant, additional solicitor general Anil Singh’s Contentions:

The decision to implement GST had been vetted by Parliament and its implementation in everyone’s interest.

The Centre and state governments had created help desks, telephonic help lines, etc. to ensure an easy transition.

65 lakh tax payers had already shifted to the new system that requires a single registration and is online, transparent and has reduced paperwork.

He stated that as long as GST had the sanction of Parliament, there was no prohibition in law to prevent the Centre from implementing GST at any point in the year.
