Chief Justice of India Dipak Misra has urged lawyers to not ask for unnecessary adjournments that cause delays in case disposals, highlighting that the judiciary doing everything to bring about speedy justice as High Courts work weekends to clear out old cases.
Speaking on the occasion of Constitution Day the Chief Justice said that pendency had reduced in the last two months since he took over and asked for cooperation to “tame the tiger” of case pendency.

 

The CJI said that if lawyers “would not take adjournments” he would assure that “pendency would drastically reduce. “

 

He further pointed out that pendency as seen in the apex court was down by 3,000 in the last few months, and HCs have cleared around 1,100 cases by working on Saturdays.

 

High Number of Vacancies Biggest Reason For Pendency

 

According to Attorney General KK Venugopal, more judges needed to be appointed in order to deal with the enormous pendency seen currently. He noted that judges per million population in India was the lowest, which was the primary reason for the delay.

Law Minister Ravi Shankar Prasad however stated that the central government had made record appointments of judges last year in both SC and HCs, and it was the judiciary’s responsibility to take the necessary steps to fill the vacancies in subordinate courts which number currently around 5,000.

Central Government Has Made Record Appointment, Law Minister Says

Prasad said that 126 appointments had been made in 2016 and so far in 2017, 106 judges had been already appointed, adding that the government was aiming to “surpass last year’s figure.”

He further pointed out that since 1993-94 the Centre had sanctioned nearly Rs.5,936 crore out of which the present administration had released Rs. 2,512 crore.

The minister has assured every form of monetary support for developing required infrastructure for judiciary.
