United States of America:

Federal appeals court, California, refused to revive President Donald Trump travel ban on people entering the United States from six Muslim-majority nations in a dispute headed to the US Supreme Court.

Six Muslim-majority nations from people were banned entry are from:

  • Iran,
  • Libya,
  • Somalia,
  • Sudan,
  • Syria and

Even before this ruling, the case was on the fast-track to the Supreme Court, where the administration of the president filed an emergency request seeking to reinstate the executive order.

ADVANCEMENTS:

Derrick Watson, Federal Judge, Hawaii blocked the executive order barring travelers from the 6 Muslim nations, Libya, Iran, Somalia, Sudan, Syria and Yemen. The ban was for 90 days. The court also resisted to decide if the order by discriminating against Muslims violates the Constitution of United States of America. The government put in place stricter visa screening. The 9th US Circuit Court of Appeals in San Francisco upheld the block on Trump’s travel ban and a cap on refugees.

Further, the March ban was President’s another attempt to implement travel restrictions on people from several Muslim-majority countries through an executive order, order of 27 January 2017 being the first such act. The order intended to outdo the legal issues, which were posed by the original ban, but the judges blocked it before it could go into effect on 16 March 2017.

Trump’s View Points:

  • Travel ban on the 6 Muslim nations shall be revived.
  • There should be a total and complete shutdown of Muslims entering the United States.
  • The renewed order is “watered down, politically correct”.

Defendant’s View Point:

  • President’s order as thinly veiled Muslim ban.
  • It will negatively impact universities and tourism industry had been harmed by the travel ban.
  • Violates federal immigration law and a section of the US Constitution’s First Amendment, which prohibits bring partial with a particular religion.
  • Trump has made “a series of barely veiled statements linking the orders to his promised Muslim ban.”

People’s Representer View points:

  • The American Civil Liberties Union represents people
  • The court should not to hear the case.
  • The ban will become moot on Wednesday, 90 days from when the order was issued.

Court’s Viewpoints:

  • the executive order was intended to discriminate against Muslims
  • violates the US Constitution’s First Amendment
  • hence, travel ban could not be revived.
