Union Cabinet Approves Draft Legislation That Will Ban Instant Triple Talaq

The Modi government has approved a draft law that will make the practice of instant triple talaq void and illegal, and also making it punishable with a jail term of three years for the husband according to a government official.

The draft legislation ‘Muslim Women Protection of Rights on Marriage Bill’ was considered and approved by the Union Cabinet , the functionary said.

Law Prepared By Inter-Ministerial Group

The bill was prepared by an inter-ministerial committee which was headed by  Home Minister Rajnath Singh and comprised other members such as Law Minister Ravi Shankar Prasad along with P P Chaudhary from the ministry, Finance Minister Arun Jaitley, and External Affairs Minister Sushma Swaraj.

The proposed law will be applicable on cases involving instant triple talaq or ‘talaq-e-biddat’.

Under it a victim can approach a magistrate to request “subsistence allowance” for herself and also any minor children.

Shaista Ambar of the All India Muslim Women Personal Law Board welcomed the draft law and urged all parties to ensure the passage of the bill in the Parliament.
