Withdrawing of a PIL Petition by the Petitioner Is it Possible?

Can a PIL that is once file by the Petitioner once, can be withdrawn by him?

No. If once cognizance of the matter has been taken by the Court and the court has issued notice to the respondents in the matter of the PIL, the petitioner looses the opportunity of withdrawing his PIL petition as the issues under the court deliberation does not relates or does not concerns his private rights or interests but to the interest and rights of the public.

But still if a Petitioner doesn’t wants to continue with the PIL and wants to withdraw himself from the matter, then in such a situation the court can permit him to do so but the petition will still continue to be before the court and the court in such a case shall appoint another petitioner to carry on with the same PIL till it is decided.

In a matter concerning a private interest of the petitioner, the court permits the petitioner to withdraw the PIL but not in a matter which is in the interest of the Public at large.
