India Ready For Entry Of Foreign Law Firms, Says Harvard Law’s Wilkins

David Wilkins, professor of law at Harvard Law School has emphasised that India’s legal sector is ready for foreign law firms to enter the country.

Commenting on the current state of India’s legal sector, Wilkins said that the quality of Indian law firms and Indian lawyers at the top “is as good as anywhere in the world”, calling it an important factor.

The Harvard Law School – Center on the Legal Profession of which Wilkins the faculty director recently completed a book on India’s legal profession, and its impact on the economy as a whole .

The book covers a six-year study that looks at the impact of globalisation on India’s legal sector.

Fight For Talent Will be Fierce

According to Wilkins, Indian law firms will need to fight the foreign law firms more over legal talent rather than clients.

He pointed  out that the competition for client may not be high since they may not be willing to pay fees readily but it could be a challenge for hiring talent.

He pointed out that Indian law firms are currently losing top talent to foreign shores. With the entry of foreign firms, talent may remain in India and Indian law firms may be required to “better train and develop the talent”  they possess.

Lawyers Critical For Country’s Society

Speaking about book, Wilkins said that the study was prompted by the fact that lawyers were becoming important to the nation again as the country becomes more legalized.

He pointed out that lawyers like Gandhi and Nehru had played a key role in India’s formation but over years the importance of lawyers had reduced.

However with country’s political, economic and social evolution, lawyers were becoming important again.

  • The economy was becoming more legalised ,with laws becoming introduced for several areas such as laws of competition, security law, privacy and corporate law.
  • Laws are also coming into play in relations between India and the global economy like the trade laws or WTO law.
  • Additionally civil society, political rights and human rights are also becoming legalised which has means that access to law and lawyers is important” .

As a result of this lawyers and their services have again become “ important for the entire society.”
