Update: Triple Talaq: Day 3

The Supreme Court continues hearing on Islamic practice of Triple Talaq today.

Mukul Rohatgi, the Attorney General (AG), would argue the matter today.

The Central government has taken the debate regarding personal laws and Article 13.

Today, personal laws will go test of Article 13, 14, and 15 of the Contitution.

The high Court of Bombay verdict in The State of Bombay v. Narasu Appa Mali will also be debated and discussed in Supreme Court of India, where the court held that the personal laws could not be invalidated if the infringe any of the fundamental rights guaranteed by our Constitution. Also, personal laws are not laws in force as per the Article 13.

While centre insisted on hearing of all 3 debatable issues of triple talaq, polygamy and nikah halala, court held hearing of all 3 debatable issues of triple talaq, polygamy and nikah halala is not possible due to paucity of time.

The 5 judge bench, headed by Chief Justice J S Khehar said that it will only hear triple talaq. It rests issues like polygamy and nikah halala for future adjudication, hence bench clarified that such issues will be discussed in future.

The centre now resumes its arguments for today.
